Overview

These terms govern your use of SureTake, a browser-based podcast recording platform operated by SureTake (a Canadian company). By creating an account or using the service, you agree to these terms. If you don't agree, please don't use SureTake.

Eligibility

You must be at least 18 years old to use SureTake. By signing up, you confirm that you meet this requirement.

Your account

You're responsible for keeping your account credentials secure. Don't share your login with others or let unauthorized people access your account.

You're also responsible for everything that happens under your account, so use it carefully.

What you can use SureTake for

SureTake is for recording podcasts and similar audio/video content. You agree not to use it to:

  • Record people without their knowledge or consent.
  • Create, store, or distribute illegal content.
  • Violate the privacy or rights of others.
  • Attempt to reverse-engineer, hack, or disrupt the service.
  • Resell or sublicense access to SureTake without our written permission.

Recording consent

You are solely responsible for obtaining consent from every person you record using SureTake. Recording laws vary by jurisdiction — it's your responsibility to comply with the laws that apply to you and your guests. SureTake is not responsible for any recording made without proper consent.

Your content

You own the recordings and content you create with SureTake. We don't claim any rights to them.

By using the service, you grant us a limited licence to store and process your content solely to provide the service to you (e.g. uploading files to your dashboard, notifying your editor).

Storage and deletion

Recordings are stored for 30 days after a session and then automatically deleted. It's your responsibility to download files you want to keep before that window closes. We are not liable for content that is deleted after the retention period.

Studio plans and client accounts

If you're on a Studio plan, you may manage client accounts and access their recordings as permitted by the plan. You are responsible for ensuring your clients have agreed to any data sharing that results from your studio access.

Payments and billing

Paid plans are billed monthly or annually. Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

You can cancel your plan at any time. Your access continues until the end of the current billing period — we don't offer prorated refunds for unused time.

If a payment fails, we'll notify you and may suspend your account until it's resolved.

Free plan

The free plan is provided as-is, with no guarantees of uptime or continued availability. We reserve the right to change or discontinue the free tier at any time with reasonable notice.

Availability

We work hard to keep SureTake reliable, but we can't guarantee 100% uptime. We may occasionally need to take the service offline for maintenance or updates. We're not liable for losses caused by downtime.

Termination

You can delete your account at any time from your Account Settings. Deleting your account will permanently remove all your data, recordings, and shows. This action cannot be undone.

Limitation of liability

To the extent permitted by law, SureTake is not liable for any indirect, incidental, or consequential damages arising from your use of the service — including lost recordings, lost revenue, or data loss. Our total liability to you will not exceed the amount you paid us in the 3 months prior to the claim.

Changes to these terms

We may update these terms from time to time. If we make significant changes, we'll let you know by email or in-app notice. Continued use of SureTake after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of Canada. Any disputes will be resolved under Canadian law.
